Carefully orchestrated indeed

The bankruptcy judge hearing the Chrysler case said Friday he wasn't going to rule on the asset sale until today or Tuesday, but a call from the White House must have prompted him to move faster because he ruled in the wee hours of this morning.

See, the administration wanted to hold up Chrysler as an example of a "quick and speedy" bankruptcy, but Judge Arthur Gonzalez - deciding he needed more time to rule - put a crimp in those plans and left the White House looking at a GM filing today and Chrysler still in. Oops.

Remarkably, Gonzalez got all his work done just in time and filed his opinion after midnight to save the show.

I'm sure we'll hear today when questioned that the White House had nothing to do with that timing, just as we've heard that it is not making management decisions at GM or Chrysler.

Rush Job on Chrysler BK Judge's Ruling

Yes, I think there was a rush job in finishing the 47 page opinion on the "sale motion". The first 41 pages are devoted to the history of the case, and to the claims made by one creditor, the Indiana Pension Funds, who Judge Gonzalez slices and dices in great detail before overruling their objections to the sale to "New Chrysler" managed by Fiat.

Then, the judge devotes only 2 pages to overruling the objections to the sale by the "terminated dealers", even though both the judge and the dealers admitted that if New Chrysler was not forced to accept all of the Chrysler dealers as part of the "sale motion", that the judge would have no ability to force "New Chrysler" to take the terminated dealers, or even some of them, when he considers that issue on 6/3. The judge cited no case law or code sections in overruling the objections of the terminated dealers, even though they had very strong claims "not to be excluded from the sale package" under specific State laws and Federal statutes.

Now that the Detroit News raises the issue, the bankruptcy judge's handling of the dealers objections to the sale motions definitely looks like he "ran out of time" to write something as substantial as the "front" of his opinion.

Our Court system is not intact. All non-left leaning judicial appointments at all levels of the federal bench have been blocked for years.

The ruling...

Funny how all of this is playing out... Kinda like something you would see in the old Sov... I mean Russia. I wonder what the bond holders think?

So how about that Obama speech today, he wants nothing to do with running GM, but he will be involved with the decisions regarding the "fundamentals" of the operations of the company? So, is it Obama Motors or isn't it? Or did they change the meaning of the word "fundamental" while I slept last night?

Manny Lopez is completely full of it. He has zero evidence to suggest that any such call to the judge ever occurred. He just blindly assumes that such a call took place without any evidence whatsoever. Shameful!

You are all missing the point.. Obama says that THIS is what America voted for. He said that investing a trillion dollars in the economy would turn this country around and put people back to work. Instead, he is closing auto dealers that didn't support Democrats while he preserves dealerships that did. He's closing plants that don't build Obama-mobiles, and he's using our tax money to supply the US government with a brand new fleet of cute little fuzzy golf carts. Did anyone read the ballots when they voted for this guy.. I thought he was running for president, not dictator. With any other president, all of this would have gone through congress to talk about and work out the details of something that will affect our country for decades to come. But Obama, being the dictator he has become, proclaims it, and the sheeple follow along, thinking this guy cares about us. Nothing could be further from the truth. Obama and the rest of the elite Democrats are using our suffering to grab power, and if you would all turn off Keith Oberman and pay attention to what's really going on, you would be kicking yourself for putting this guy into power. Votes matter and 52% of America really screwed it up this time. But don't blame yourselves though. If the news media had done it's job properly, being given the "watchdog" postion by our founding fathersand all, Obama would still be back in the Senate voting "present" for the next 4 years, and we'd all be blaming McCain for this mess.. At least McCain promised to freeze government spending. So, we'd all be broke and jobless, but at least our grand kids wouldn't be left with the bill!!

White House Influences Judge

This is illegal and leaves the results of the Judges decision in question. It is the same theory that was used to make null and void the investigation of a military officer and his conduct due to command influence.

Unethical behavior?

One side cannot contact the Judge without the other side being made aware. Lawyers know this is unethical. Judges must be impartial and not give in to pressure otherwise the judicial system will not function and people will take their disputes into their own hands out of frustration.

That's disturbing -- it's none of the administrative branch's business how long another branch takes to properly execute its duties.

What makes it all the more disturbing is that the government has a dog in this hunt. The more I see from Barack Obama, the less I care for him.

Obama abuse of the legal system

I fear that we are headed for a Constitutional crisis brought on by the very extra-constitutional activities of the Obama administration. The use of strong arm tactics, the abregation of constract to the benefit of the government and prefered third parties, and the use of "Czars", powerful representatives of the executive branch that are not subject to the advise and consent of the congress, are all seemingly in violation of the separation of powers and the Constitution itself. The courts must put an end to this while they still can.

If we dare let the administration continue down this path we will loose the rights guaranteed to us in return for the rights granted to us by our government. We must remember that in a republic the power resides with the people and that their representatives in government are there to serve them not the reverse.

Obama abuse of the legal system

The Obama administration see themselves as above the law. First they attempted to extort the representatives for the GM note holders into betraying their fiduciary responsibility to their clients by threatening to use the slavishly compliant White House press to destroy the reputation of their companies. Worthy of an episode of the Sopranos. Now they have stepped up their use of intimidation from lawyers to judges. Right now they are getting away with these illegal and unconstitutional abuses. It seems that every day a new "czar" is appointed over yet another aspect of what used to be a free country. The time will come when the courts and legal system turn on these tyrants and put them in jail as they deserve.
